A lawsuit is being prepared against medical products manufacturer DePuy, a company that belongs to the Johnson & Johnson group – well known for their healthcare products and also a big name in the health business in general. DePuy specializes in prosthetics and other surgical implant equipment and has a range of hip replacement products that range from full hip replacement equipment to partial hip replacement devices. These hip replacement devices started this whole controversy and eventually led to the lawsuit. Reports indicate that the equipment is faulty and that the friction between two parts of the prosthetic generates debris that is harmful to the patient. This isn’t at all an unknown side effect to these surgeries, what is uncommon is the alarming number of patients that it has happened to – reportedly one in every eight.
But you might wonder: even though the number of patients suffering from complications directly linked to the faulty equipment is so high, why is a lawsuit being moved against the company? The DePuy lawsuit is also based on reports that the company may have known about this problem with their equipment but chose not to act upon it sooner. The devices have now been recalled, but patients and lawyers alike feel that the recall could have been done a lot sooner, which would have prevented further problem cases. There is also plenty of legal precedent to sue a company such as this for faulty products, and the most notorious cases taken to court have resulted in settlements in favor of the patients.
